Terms and Conditions

Booking and confirmation

A booking is confirmed when SOMA has acknowledged it in writing. Until then, dates, vessels and departure times are provisional and may change.

Fees collected locally

Municipal eco-tourism fees, lagoon and beach entrance fees, cave and waterfall fees and similar charges are set and collected by local authorities. They are not included in SOMA fares unless expressly stated, and they change without notice to us.

Weather, safety and itinerary changes

All marine and aerial activities are subject to weather, sea state and the decisions of the Philippine Coast Guard and other authorities. The master of a vessel or the pilot in command has final authority over whether a trip runs, which stops are made and in what order. Where a trip cannot proceed for safety reasons we will offer an alternative date or a refund of the SOMA portion of the fare.

Third-party services

Certain activities, including scuba instruction and certification, skydiving and helicopter flights, are delivered by qualified third-party operators working under agreement with SOMA. Scuba certification is issued by the affiliated PADI dive centre, not by SOMA. Those operators carry their own professional qualifications and insurance, and their terms apply to the activity itself.

Health, fitness and honesty

Some activities carry inherent risk and require a stated level of health and fitness. You must disclose relevant medical conditions when booking. We may decline participation where we believe an activity is unsafe for you or for others.

Passenger information

We collect the full name and contact number of every passenger. This is required for maritime passenger manifests and is used for safety and regulatory purposes.

Cancellation

Cancellation terms vary by product and are confirmed in writing at the time of booking. Multi-day expeditions and chartered vessels carry longer notice periods than day tours.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, to the extent that such limitation is not permitted under Philippine law.

Governing law

These terms are governed by the laws of the Republic of the Philippines.
